Terms of Service

1. Introduction and Agreement

Welcome to Drober! These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," "your") and Recherche Ventures e.U. (DI Marc Fenz), located at Alfred-Coßmann-Gasse 14/2, 8054 Graz, Austria, Company Registry Number: FN 659947k, Registry Court: Landesgericht für Zivilrechtssachen Graz ("Company," "we," "us," "our").

These Terms govern your access to and use of the Drober mobile application ("App"), the website located at drober.app (or related domains), and all related services, features, and content (collectively, the "Service").

By creating an account and ticking the box indicating your acceptance, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not create an account or use the Service.

2. Description of the Service

Drober is a digital service designed to help users organize and manage their personal wardrobe. Key features include digital closet organization, outfit planning, tracking garment usage, and the ability to share wardrobe items or outfits with other users.

Important Disclaimers:

• Informational and Organizational Purposes Only: The Service is provided for personal organizational purposes.
• No Professional Advice: The Company does not provide professional fashion, styling, or dry-cleaning advice. Any suggestions provided by the App (e.g., outfit recommendations) are automated and for inspiration only.
• Visual Representation: We cannot guarantee that the colors or details of clothing items displayed in the App will perfectly match the physical items, as this depends on your device’s screen and the quality of uploaded photos.
• Service Tiers: The Service is offered on a "freemium" model. A basic tier is available for free, while certain advanced features (e.g., unlimited items, advanced analytics) may require a paid subscription ("Premium Tier"). We reserve the right to change features and limits at our discretion.

3. User Accounts

Eligibility

You must be at least 18 years of age (or the minimum legal age in your country) to create an account.

Account Creation

You agree to provide accurate information (email, username, password). You are responsible for maintaining the confidentiality of your login credentials.

User Responsibilities

You are solely responsible for:

• All activities under your account.
• Maintaining up-to-date information.
• Backing up your data. The Company is not liable for the loss of your wardrobe data or photos.

4. User-Generated Content and Data

Ownership

You retain full ownership of all photos of clothing, outfit descriptions, and other information you upload ("User Content").

License to Us

To operate Drober, you grant the Company a limited, worldwide, non-exclusive, royalty-free license to use, store, and display your User Content solely to:

• Provide and improve the Service for you.
• Display your wardrobe to you and any users you explicitly choose to share it with.
• Generate anonymized, aggregated data for statistical analysis (e.g., general fashion trends), which will not identify you personally.

Prohibited Data

Do not upload images that are not related to your wardrobe or that contain sensitive personal information, nudity, or copyrighted material you do not own.

5. Sharing Functionality

Drober allows you to share digital closets, specific items, or outfits with other users.

• Your Responsibility: You are responsible for ensuring you have the right to share the images and data you upload, especially if other people appear in your photos.
• Control: The user who initiates a share (e.g., a "Shared Closet") is the primary controller of that data within the App.
• Disputes: The Company is not a party to any disputes or "borrowing" agreements between users. Use the sharing feature at your own discretion.

6. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose.
• Upload malware or attempt to breach our security.
• Reverse-engineer the App.
• Use Drober to harass, stalk, or spam other users via sharing features.

7. Fees, Payments, and Subscriptions

• Premium Services: Fees for subscriptions will be clearly disclosed.
• Processors: We use third-party processors (Apple App Store, Google Play Store, Stripe, etc.). Their terms also apply.
• EU Right of Withdrawal: As an EU consumer, you have a 14-day withdrawal right. However, you acknowledge that by accessing Premium features immediately upon purchase, you lose this right as the service performance has begun.

8. Termination

• By You: Delete your account via the App settings at any time.
• By Us: We may suspend or terminate access for breaches of these Terms, prolonged inactivity, or if we discontinue the Service.
• Data Deletion: Upon termination, we handle your data per our Privacy Policy and GDPR requirements.

9. Disclaimers & Limitation of Liability

"AS IS" Service

The Service is provided "as is." We do not guarantee that the App will be uninterrupted or error-free. Data loss or syncing errors may occur.

Limitation of Liability

To the fullest extent permitted by Austrian law, Recherche Ventures e.U. shall not be liable for indirect or consequential damages. This limitation does not apply to:

• Intentional misconduct (Vorsatz).
• Gross negligence (grobe Fahrlässigkeit).
• Injury to life, body, or health.

For simple negligence (leichte Fahrlässigkeit) involving essential contractual obligations, liability is limited to typical, foreseeable damages.

10. Data Privacy and Business Transfers

Your data is hosted on servers within the European Union. In the event of a merger, acquisition, or sale of the Drober project, your data may be transferred to the new owner, provided you are notified in advance.

11. Governing Law and Jurisdiction

• Governing Law: Laws of the Republic of Austria.
• Jurisdiction: Competent courts of Graz, Austria. EU consumers may also bring claims in their country of residence.
• EU ODR: Consumers can use the Online Dispute Resolution platform at ec.europa.eu/consumers/odr .
